Terms of Use

These Terms govern your use of Mello. The service is provided by Sebastian Scharlipp, trading under the business name blytz, Havelweg 11, 89233 Neu-Ulm, Germany (“Mello”, “we”, “us”).

These Terms supplement Apple’s Standard Licensed Application End User License Agreement. Mandatory consumer rights always remain unaffected.

1. Service and eligibility

Mello lets you submit links to publicly accessible social-media posts, convert available recipe information into a structured recipe, save recipes, edit your personal copy, and use supporting planning features.

You must be legally capable of entering into these Terms. If applicable law requires permission from a parent or legal guardian, you may use Mello only with that permission.

2. Submitted links and third-party content

Only submit content that you may lawfully access and process. Do not use Mello to bypass access controls, obtain private content, infringe intellectual-property or personality rights, or process unlawful material.

Original posts remain subject to the rights and terms of their creators and platforms. Mello does not claim ownership of them. A source link may stop working if the post is changed, removed, restricted, or made private.

If you are a rights holder and believe a source reference or recipe record infringes your rights, contact us at the address in Section 13 and provide the source URL, the affected right, and information that allows us to assess the request.

3. AI-assisted recipe processing

Mello uses automated systems, including artificial intelligence, to extract, organize, normalize, translate where needed, or conservatively complete recipe information. Inferred content is intended to be marked where technically available and all recipe fields remain editable.

Automated results may be incomplete or wrong. Before cooking, check the original source where available and verify ingredients, quantities, allergens, dietary suitability, cooking temperatures, timing, and food safety. Mello does not provide medical, nutritional, allergen, or professional food-safety advice.

4. Technical account and saved data

On first launch, Mello automatically creates a pseudonymous technical account through Firebase Authentication. No name or email address is required for this account. The account and its data are nevertheless linked through technical identifiers and are not anonymous in the legal sense.

You can initiate deletion of the technical account in Settings. Deleting an individual recipe removes it from your personal library. A shared canonical recipe record may remain independently of your account as described in the Privacy Policy.

You are responsible for protecting access to your device. Because the current technical account is device-based, deleting the app or losing the device may make your personal library inaccessible unless an available purchase or account recovery mechanism applies.

5. Trial and subscriptions

Mello Pro is offered as an auto-renewable in-app subscription through Apple. The product, term, localized price, any introductory trial, and renewal information shown on Apple’s purchase screen at the time of purchase are authoritative.

Unless canceled through Apple before renewal, the subscription renews automatically and Apple charges the selected payment method. Apple handles the transaction, billing, cancellation, and refund process under its rules. Use Manage Subscription in Mello or Apple’s subscription settings to cancel. Restore Purchases can restore an eligible Apple purchase.

Deleting the Mello app or account does not cancel an Apple subscription. Conversely, canceling a subscription does not itself delete the Mello account. Paid functionality may be restricted when no active entitlement exists; access normally continues until the end of a paid cancellation period unless Apple or applicable law provides otherwise.

6. Acceptable use

Do not misuse the service, interfere with its operation, submit excessive automated requests, probe or circumvent security, distribute malware, impersonate another person, or use Mello in violation of law or applicable third-party terms.

We may reasonably limit or suspend abusive activity to protect users, rights holders, providers, and the service. Statutory rights and any required notice remain unaffected.

7. Availability and changes

We aim to provide a reliable service but cannot guarantee uninterrupted availability or that every source can be processed. Social platforms and technical providers may change, restrict, or discontinue access.

We may improve, modify, or discontinue features. Material changes affecting paid access or these Terms will be communicated as required by law.

8. Intellectual property and user edits

Mello’s software, brand, interface, and original materials are protected by law. Subject to these Terms and the Apple license terms, you receive a limited, personal, non-transferable right to use the app.

You retain any rights you hold in your own edits and content. You grant us a non-exclusive right to host, process, synchronize, and display that material only as necessary to provide and secure Mello. This does not grant rights in third-party source content that you do not possess.

9. Statutory rights and liability

We are liable without limitation for intent and gross negligence, for injury to life, body, or health, under mandatory product-liability law, and where we have expressly assumed a guarantee.

For slight negligence, we are liable only for breach of an essential contractual obligation whose performance is necessary for proper use of Mello and on whose performance you may regularly rely. In that case, liability is limited to the foreseeable loss typical for the contract. Otherwise, liability for slight negligence is excluded to the extent permitted by law.

The limitations also apply to our legal representatives and agents. Mandatory statutory consumer, warranty, and digital-product rights remain unaffected.

10. Ending use

You may stop using Mello at any time and may initiate account deletion in Settings. Subscription cancellation must be completed separately through Apple.

We may terminate or restrict access for material or repeated violations, subject to applicable law. Provisions that by their nature survive termination remain in effect.

11. Apple relationship

Apple is not responsible for operating or supporting Mello. To the extent provided by Apple’s Standard EULA, Apple and its subsidiaries are third-party beneficiaries of the license agreement and may enforce it. Apple’s own terms govern the App Store, payment account, and transaction.

12. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections of the country in which you habitually reside. Statutory rules determine jurisdiction; no exclusive consumer venue is agreed by these Terms.
